1. Introduction
Sedgars Home is committed to protecting privacy and processing personal information lawfully, reasonably and transparently. This Privacy Policy explains what personal information we collect, where we obtain it, why we use it, when we share it, how we protect it and the rights available to data subjects.
Sedgars Home is operated by Bravospan 247 (Pty) Ltd. In this policy, "Sedgars Home", "we", "us" and "our" refer to the responsible party that determines why and how personal information is processed for Sedgars Home's activities.
This policy applies to customers, prospective customers, website visitors, store visitors, delivery recipients, competition entrants, newsletter subscribers, suppliers and other people who interact with Sedgars Home. It covers information processed through our website, stores, warehouses, customer-care channels, telephone, email, WhatsApp, social media, delivery operations and related services.
2. What personal information we collect
Depending on how you interact with us, we may collect the following categories of personal information:

Payment and finance information, such as payment method, transaction references and information required by a payment, finance, lay-by or credit provider. Full card details are ordinarily collected directly by the relevant payment service provider and are not intentionally stored on Sedgars Home's website systems.

Communications and support information, such as enquiries, complaints, call or message records, returns information, photographs or videos supplied in support of a claim, and customer-service history.

Website and device information, such as IP address, browser and device type, operating system, referring pages, pages viewed, clicks, session information, approximate location and cookie or similar technology identifiers.

Premises information, which may include CCTV footage and visitor or access records where used for safety, loss prevention and security.

Marketing and engagement information, such as newsletter subscriptions, campaign responses, competition entries, advertising interactions and inferred interests based on lawful website or purchase activity.
We do not intentionally collect special personal information unless it is reasonably necessary, permitted by law and handled with appropriate safeguards.
3. How we collect personal information
We collect personal information:

directly from you when you browse or buy online, visit a store, create an account, request a quotation, arrange delivery or collection, contact us, enter a competition, subscribe to marketing or submit a return, warranty or service request;

from payment gateways, finance providers, delivery providers, social-media platforms, fraud-prevention services and other service providers where this is necessary to complete a transaction or provide a requested service;

from lawful public sources or business partners where POPIA permits this and the information is relevant to a legitimate purpose.
If you provide us with another person's personal information, you must be authorised to do so and should ensure that the person is aware of this policy where reasonably practicable.
4. Why we process personal information
We process personal information only where POPIA or another applicable law permits it. Depending on the circumstances, processing may be necessary to perform or prepare for a contract, comply with a legal obligation, protect a legitimate interest, pursue our legitimate business interests without overriding your rights, or act with your consent.
We may use personal information to:

create and manage customer accounts, profiles and preferences;

process payments, quotations, purchases, finance or lay-by applications, orders, collections, deliveries, assembly, returns, refunds, exchanges and warranties;

verify identity, prevent fraud, maintain security, protect customers and staff, and investigate suspected unlawful activity;

communicate order confirmations, delivery updates, service messages and responses to enquiries or complaints;

provide customer support and administer after-sales service;

operate, secure, troubleshoot, analyse and improve our website, stores, services, products and customer experience;

conduct customer research, analytics, reporting and forecasting, using aggregated or de-identified information where reasonably possible;

support a lawful sale, merger, reorganisation or transfer of all or part of our business, subject to appropriate confidentiality and data-protection safeguards.
5. When information is required
Some information is mandatory because it is needed to process an order, take payment, arrange delivery or collection, verify identity, comply with law or provide a requested service. Other information, such as optional marketing preferences, is voluntary.
If you do not provide mandatory information, we may be unable to complete a transaction, deliver an order, process a return or provide the requested service. We will, where reasonably practicable, indicate when information is required and explain the consequence of not providing it.
6. Sharing personal information
We do not sell or rent personal information as a business practice. We may share relevant personal information only as reasonably necessary with:

Service providers that process personal information for us are expected to process it only for authorised purposes, maintain confidentiality and implement appropriate security measures. We may also use aggregated or de-identified information that does not identify a person.
7. Cookies and similar technologies
Our website may use cookies, pixels, tags, local storage and similar technologies. These tools may be used to keep the website secure, remember choices, maintain a shopping cart, understand website performance, measure campaigns and provide relevant advertising.

8. Direct marketing
We may send marketing by email, SMS, WhatsApp or other electronic channels only where permitted under POPIA. This may be based on your consent or, in the case of an existing customer, where we obtained your contact details in connection with a sale and market our own similar products or services, provided that the required opt-out opportunities are given.
Each electronic marketing communication will identify the sender and provide a reasonable way to opt out. You may unsubscribe through the link in an email, use the stated STOP or opt-out instruction, adjust available preferences or contact us. Sedgars Home will not charge you for processing an opt-out request. Opting out of marketing will not stop service communications that are necessary for an existing order, delivery, account, safety notice or legal obligation.
9. Cross-border processing
Some website, cloud, payment, communications, analytics or support providers may store or process personal information outside South Africa. Where personal information is transferred to a recipient in another country, Sedgars Home will take reasonably practicable steps to ensure that the transfer complies with section 72 of POPIA, including by relying on adequate laws, binding agreements, appropriate safeguards, consent where valid, or another ground permitted by law.
10. Retention and disposal
We retain personal information only for as long as reasonably necessary to achieve the purpose for which it was collected, meet contractual requirements, resolve disputes, exercise or defend legal rights, and comply with legal, tax, accounting, warranty, fraud-prevention and record-keeping obligations.
Retention periods differ according to the type of record and applicable requirements. When personal information is no longer authorised or required to be retained, we will delete or destroy it, or de-identify it, as soon as reasonably practicable and in a manner intended to prevent reconstruction. Backups may remain for a limited period until securely overwritten in the ordinary backup cycle.
11. Information security and security compromises
Sedgars Home uses appropriate, reasonable technical and organisational measures designed to protect personal information against loss, damage, unauthorised destruction, unlawful access and unlawful processing. These measures may include access controls, authentication, secure communications, monitoring, backups, staff confidentiality obligations, security reviews and contractual safeguards for service providers.
No system can be guaranteed completely secure. If we have reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, we will investigate, take reasonable containment and remediation steps, and notify the Information Regulator and affected data subjects as soon as reasonably possible where POPIA requires notification, subject to any lawful delay.
12. Your rights
Subject to POPIA, PAIA and other applicable law, you may have the right to:

ask us, free of charge, to confirm whether we hold personal information about you;

request access to a record or description of your personal information, subject to the prescribed process and any lawful fee;

request correction, updating, deletion or destruction of personal information that is inaccurate, irrelevant, excessive, outdated, incomplete, misleading, unlawfully obtained or no longer authorised to be retained;

object, on reasonable grounds, to certain processing of your personal information;

withdraw consent at any time where processing is based on consent, without affecting processing that was lawful before withdrawal;

object to or opt out of direct marketing;
-
request restriction of processing in circumstances recognised by law;

be notified of a qualifying security compromise; and
-
lodge a complaint with the Information Regulator or institute proceedings where permitted by law.
To protect your information, we may ask for adequate proof of identity and enough information to locate the relevant records. We will respond within a reasonable time and may refuse or limit a request only where the law permits or requires this. Access requests may also be governed by our PAIA Manual where applicable.
13. Children and minors
Our website and services are not directed at children. A person under 18 should use the website or make a purchase only with the involvement and permission of a parent or legal guardian. Where we process a child's personal information, we will do so only with the authorisation of a competent person or another ground permitted by POPIA and will apply appropriate safeguards.
14. Automated processing and fraud screening
We may use automated tools to support security, fraud detection, website functionality or service prioritisation. We will not make a decision based solely on automated processing that has legal consequences for you or affects you to a substantial degree unless POPIA permits it and appropriate safeguards are in place, including an opportunity to make representations where required.
15. Third-party websites and services
Our website may contain links to third-party websites, payment services, finance providers, social-media platforms or other services. Those third parties may process personal information under their own privacy policies. Sedgars Home does not control their independent privacy practices, and you should review the relevant third-party notice before providing information.
16. Changes to this policy
We may update this policy to reflect changes in law, technology, our services or our processing practices. The latest version will be published on our website with its effective or last-updated date. If a change is material, we may provide an additional notice through an appropriate channel.
17. Statutory rights
Nothing in this policy is intended to exclude or limit any right or obligation under the Protection of Personal Information Act 4 of 2013, the Promotion of Access to Information Act 2 of 2000, the Electronic Communications and Transactions Act 25 of 2002, the Consumer Protection Act 68 of 2008 or other applicable South African law. If this policy conflicts with mandatory legislation, the legislation will take precedence.
